1. About Us

MotorMuse ("we", "us", "our") operates the website www.motormuse.com (the "Website"). We sell personalised, edited and framed prints of customers' vehicles, produced from photographs supplied by you.
We are a sole trader trading as MotorMuse, with a business address of 2 Albany Road, NN1 5LZ, Northampton, UK.

These Terms and Conditions ("Terms") govern your use of the Website and your purchase of products from us. By placing an order, you confirm that you accept these Terms.

2. Eligibility

To place an order you must be at least 18 years old and capable of entering into a legally binding contract.

3. Products

3.1. Each product is a bespoke, made-to-order item created from a photograph you upload, together with any personalisation options you select (such as framing, text, colour treatment or style).
3.2. Because every print is edited by hand, the finished product may vary slightly from any on-screen preview or mock-up. Colours may also appear differently depending on your screen settings, printing materials and framing.
3.3. We aim to describe and picture our products as accurately as possible, but minor variations in colour, finish, framing and dimensions do not constitute a defect.

4. Your Uploaded Photographs and Content

4.1. When you upload a photograph or other content, you confirm that:
you own the photograph or have permission from the copyright owner to use it for this purpose;
the content does not infringe any third party's intellectual property, privacy or other rights;
the content is not unlawful, offensive, defamatory or otherwise objectionable; and
you have the right to feature any vehicle, person, logo or property shown in the image.
4.2. You grant us a licence to use, store, reproduce and edit your uploaded content solely for the purpose of fulfilling your order.
4.3. We may, with your separate consent, use images of finished products for marketing and promotional purposes. We will ask for this consent during or after the order process, and you may withdraw it at any time by contacting us.
4.4. We reserve the right to refuse or cancel any order where the uploaded content is unlawful, infringes rights, is of insufficient quality to produce an acceptable print, or is otherwise unsuitable. Where we cancel for these reasons, we will refund any amount you have paid.

5. Orders and Contract Formation

5.1. After you place an order, you will receive an acknowledgement email confirming we have received it. This does not mean your order has been accepted.
5.2. A contract between you and us is formed only when we send you an email confirming that your order has been accepted and is being produced.
5.3. We reserve the right to reject any order, including where the product is unavailable, where there has been a pricing or description error, or for the reasons set out in clause 4.4.

6. Pricing and Payment

6.1. Prices are shown on the Website in GBP and are inclusive of UK VAT where applicable. Shipping costs are calculated and displayed before you complete your order.
6.2. For international orders, the price does not include import duties, taxes or customs charges levied by the destination country. You are responsible for paying any such charges (see clause 8).
6.3. Payment is taken in full at the time you place your order. We accept payment via Stripe and PayPal, using the payment methods shown at checkout.
6.4. If a product's correct price differs from the price shown due to an obvious error, we will contact you before accepting your order, and you may confirm the order at the correct price or cancel it.

7. Production and Delivery

7.1. Production times and estimated delivery times are shown on the Website or in your order confirmation. These are estimates only and not guaranteed.
7.2. We offer delivery within the UK and international shipping. Delivery options and costs are shown at checkout.
7.3. Risk of loss or damage passes to you when the product is delivered to the address you provide. Please ensure your delivery details are correct, as we cannot be responsible for items sent to an incorrectly supplied address.
7.4. If your order arrives damaged, please contact us within 14 days of delivery with photographs of the damage so we can arrange a replacement or refund (see clause 9).

8. International Shipping, Customs and Duties

8.1. International deliveries may be subject to import duties, taxes and customs clearance fees charged by the destination country. These are your responsibility and are payable in addition to the order price and shipping cost.
8.2. We have no control over these charges and cannot predict their amount. Please check with your local customs office before ordering if you are unsure.
8.3. Delivery timescales for international orders may be affected by customs processing, which is outside our control.

9. Cancellation, Returns and Refunds

9.1. Personalised and bespoke goods. Under the Consumer Contracts Regulations 2013, the standard 14-day right to cancel does not apply to goods that are made to your specification or clearly personalised. As all our products are bespoke and made from your uploaded photograph, you do not have a right to cancel or return them once production has begun, except where the product is faulty or not as described.
9.2. Before production begins. If you wish to cancel an order before we have started production, please contact us as soon as possible. Where we have not yet begun production, we will cancel your order and provide a full refund.
9.3. Faulty or misdescribed products. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If your product is faulty, damaged on arrival or not as described, you are entitled to a repair, replacement or refund. Please contact us within 14 days of delivery with details and photographs.
9.4. Refunds, where due, will be made to your original payment method within 14 days of us agreeing that a refund is payable.

10. Intellectual Property

10.1. All content on the Website, including text, graphics, logos, designs and the "MotorMuse" name, is owned by or licensed to us and is protected by intellectual property laws. You may not reproduce it without our permission.
10.2. You retain ownership of your uploaded photographs. We retain ownership of the editing, design and creative work applied in producing your print.

11. Our Liability

11.1. We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.
11.2. Subject to clause 11.1, our total liability to you arising from any order is limited to the price you paid for that order.
11.3. We are not liable for losses that were not foreseeable, or for losses arising from your failure to provide accurate information or suitable photographs.

12. Events Outside Our Control

We are not responsible for delays or failures to perform caused by events outside our reasonable control, including postal and courier delays, customs processing, supply shortages, and other force majeure events. We will take reasonable steps to minimise any delay.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The version in force at the time you place your order is the version that applies to that order.

15. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another country, you may also have the protection of mandatory provisions of your local law.
